GENERAL INFORMATION

The purpose of these general conditions of sale is the purchase of components and spare parts for lifts carried out remotely via computer network on the website cmf-frigerio.it to persons with a VAT number.

Each purchase transaction is governed by the provisions of Legislative Decree 185/99, Legislative Decree 206/05; information directed to the conclusion of the contract will be subject to Article 12 of Legislative Decree 70/03.

As regards the protection of the confidentiality of users’ data, this will be subject to the regulations set out in Legislative Decree 196/03.

The service is available for the following countries: Austria, Belgium, Czech Republic, Germany, Denmark, Estonia, Finland, France, Greece, Hungary, Iceland, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden.

CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL TERMS AND TERMS OF SALE

The sales contract for the products on the cmf-frigerio.it website is considered concluded when the purchase order made by the customer is received, together with payment. C.M.F. s. n. c. di Paolo Frigerio e C. (hereinafter also referred to as: the Seller) will send the customer the receipt of the purchase order made by the customer.
By sending the purchase order electronically, the client declares that he has read and accepted the present general conditions of contract and undertakes to observe and respect them in his dealings with the vendor.

PROCESSING OF PERSONAL DATA

Pursuant to art. 13 of Legislative Decree 196/2003, C.M.F. s.n.c. di Paolo Frigerio e C. informs you that the personal and fiscal data acquired, even verbally, in reference to the business relations established, supplied directly by the interested parties, or otherwise acquired within the scope of the company’s activity, will be processed in compliance with the aforementioned regulations, including the obligations of confidentiality provided for in relation to the aforementioned, the rights as per article 7 of Legislative Decree 196/2003 may be exercised.

OBLIGATIONS OF THE CLIENT

The Customer is obliged to read these general terms and conditions of sale carefully before submitting his purchase order. Submitting a purchase order implies full knowledge and acceptance of these terms and conditions. Lastly, once the on-line purchase procedure has been completed, the Customer is required to print and keep these general sales conditions, which have already been viewed and accepted during the contract conclusion phase.

ORDER DEFINITION

By sending the order on-line, the Customer transmits to C.M.F. s.n.c. di Paolo Frigerio e C. a proposal to purchase the product and/or the products placed in the trolley. When the Customer places an order online for the products he has placed in the cart, he accepts to purchase them at the price and under the terms indicated in these General Conditions of Sale.

C.M.F. s.n.c. di Paolo Frigerio e C. will inform the Customer of the acceptance and confirmation of the order.

PURCHASING METHODS

The Customer buys the product, the characteristics of which are illustrated online in the relevant descriptive and technical sheets, at the price indicated therein, plus the delivery costs specified on the site in the dedicated page.
The Customer may decide whether to conclude the order with payment by credit card or bank transfer.
Before the purchase order is sent, the unit cost of each product chosen is summarised, as well as the total cost in the event of purchasing several products and the relative delivery costs. Once the purchase order has been forwarded, the Customer will receive an e-mail message
from C.M.F. s.n.c. di Paolo Frigerio e C. confirming receipt of the purchase order and containing information relating to the main characteristics of the goods purchased, a detailed indication of the price, the delivery costs, the applicable taxes and the means of payment and containing a reference to the general contractual conditions and information regarding the existence of the right to withdraw, the conditions and methods of its exercise displayed on the site.

All the prices on the site include VAT and the minimum spending limit so that the order can be processed is € 50.00 (fifty/00), excluding shipping costs.
Once the order has been placed, it is registered in the system and from this moment it is no longer possible to make changes or cancel it.

Orders will only be processed and shipped following receipt of payment.

PAYMENT METHODS

The Customer may make the payment due in one of the following ways.

– Credit card
We work with the main circuits (Visa, MasterCard, Diners, American Express, JCB and China Union Pay (CUP). Payment information is encrypted during transmission. Payment is handled by NEXI. All transactions take place in real time using the 3DSecure Hosted XML protocol.

– Bank transfer
Bank transfer payments must be finalised within 3 (three) working days from the date of purchase, otherwise the order will be cancelled.

The reason for the order must include the order number.

ATTENTION: in case of payment by bank transfer, delivery times may be longer.

 Once the order has been received and confirmed, it will be dispatched within 15 (fifteen) working days.
Some products may require a longer processing time: in this case, the Purchaser will be contacted by customer service.

The purchased goods, together with the relevant invoice, are delivered by courier to the address specified by the Customer at the time of the on-line order.

The cost of shipping is notified to the customer before the order is finalised.
Shipments are made by BRT or Fischer & Rechsteiner couriers. To find out the delivery times, please consult the dedicated page of the respective carriers.

GUARANTEE OF CONFORMITY AND DEFECTED PRODUCTS

In accordance with current legislation, the products are covered by a legal guarantee of 1 (one) year. If a malfunction or lack of conformity is detected, the Customer must promptly report it to info@cmf-frigerio.it.

The costs of returning the goods will be borne by C.M.F. s.n.c. di Paolo Frigerio e C.

RIGHT OF WITHDRAWAL

In any case, the Purchaser has the right to withdraw from the contract entered into, without any penalty and without specifying the reason, within 14 (fourteen) days, starting from the day of receipt of the goods purchased. If the Purchaser decides to avail himself of the right of withdrawal, he must notify the seller by e-mail at ecommerce@cmf-frigerio.it.

The product must be returned to the Seller intact in all its parts, unused and complete with the original box. The Customer is obliged, under penalty of non-acceptance of the return, to enclose a copy of the return note which must quote the number of the sales note issued by C.M.F. s.n.c. di Paolo Frigerio e C. As soon as the package reaches its destination, it will be inspected and a refund will be made using the same method of payment chosen at the time of ordering. Shipping costs will not be refunded.

The return must be agreed in advance with the Seller by sending an email to ecommerce@cmf-frigerio.it. The cost of returning the goods shall be borne by the Customer.

With the receipt of the communication with which the Customer communicates the exercise of the right of withdrawal, the parties to this contract are released from their mutual obligations, without prejudice to the provisions of the previous points of this article.

C.M.F. s.n.c. di Paolo Frigerio e C. has the right to reject any product returned using methods other than those specified above, as well as products which are not intact or for which the customer has not paid the return costs in full, or has not respected the methods and times indicated for the communication of the exercise of the right of withdrawal.

EXPRESS TERMINATION CLAUSE

In the event of total or partial non-payment of the purchase price of the goods, C.M.F. s.n.c. di Paolo Frigerio e C. reserves the right to declare the present contract terminated, pursuant to and for the purposes of art. 1456 of the civil code, by sending a written communication to the customer’s e-mail address.
